Hit by a Vehicle While Walking or Jogging?

Contact Our Pedestrian Accident Law Firm for Free Legal Advice

Since walkers and joggers have no protection against the force of an impact with a car, pedestrian accidents often cause catastrophic injuries and wrongful death. In fact, the National Highway Traffic Safety Administration (NHTSA) reports that each year at least 5,000 deaths result from automobiles striking pedestrians. Furthermore, more than 78,000 pedestrians sustain serious injuries each year after being struck by motor vehicles, including passenger cars, trucks and buses. In most cases, these accidents result from motorist negligence. Distracted or careless drivers may fail to notice pedestrians in crosswalks or along the side of the road. Since the motorist is typically at fault, victims and their families can often recover compensation through an insurance claim or personal injury lawsuit against the driver.

At Regan Zambri Long PLLC, our personal injury attorneys regularly obtain multi-million-dollar settlements and verdicts on behalf of seriously-injured pedestrians. Recently, our pedestrian accident law firm successfully represented a client who suffered a traumatic brain injury as a result of being struck by a WMATA/Metro bus while using a crosswalk in Washington DC. We also obtained one of the highest settlements in the area against WMATA; the case involved the tragic death of a pedestrian who was crossing the street when she was struck by a Metro bus. In another case, our office obtained a multi-million-dollar settlement on behalf of a woman who was struck by a private tour bus while crossing the street. We can use this experience to aggressively pursue your claim from the first client meeting until the resolution of the case.

What Injuries May Result from a Pedestrian Accident?

When a car, bus or truck hits a pedestrian, the injuries can be devastating. Pedestrians are much more vulnerable to injury and death on a roadway than the passengers in vehicles, which have safety features such as seatbelts, airbags and roll cages. Common pedestrian injuries include:

  • Traumatic brain injuries. Depending on the location and extent of the trauma, brain injuries can cause permanent physical and mental impairment.
  • Neck and spinal cord injuries. The force of impact from a vehicle can damage a pedestrian’s spine and spinal cord. This may cause permanent paralysis or impaired movement below the site of the injury.
  • Loss of limb. In some circumstances, a pedestrian accident can cause a traumatic amputation or cause such extensive injuries that an amputation is necessary.
  • Muscle and tissue damage. The initial crash or secondary impacts with the ground or other objects can cause extensive damage to the muscles and tissues. In the most serious cases, this can cause permanent disability or require extensive treatment.
  • Nerve damage. Deep lacerations, broken bones and other injuries may also damage the nerves, which is often irreversible.
  • Respiratory dysfunction. The force of a crash can cause a punctured and/or collapsed lung. This type of injury requires emergency treatment and may take months to fully heal. In some cases, brain injuries may result from lack of oxygen as well.
  • Disfigurement and scarring. Widespread tissue damage and/or lacerations can cause permanent scarring. Disfigurement, especially to the face, can have a profound impact on a victim’s psychological health.
  • Wrongful death. Pedestrians may suffer fatal injuries, especially in accidents involving large vehicles, like commercial trucks and city buses.

Many victims require specialized care, including long-term physical and psychological treatment. The pain and anguish suffered by pedestrians are often extreme and medical costs can be staggering.

What Should I Do After a Pedestrian Accident?

After a pedestrian accident, many victims require emergency medical care. Therefore, if you are a pedestrian hit by a car or witness someone else being struck by a vehicle, then you should call an ambulance immediately, if you are able. Depending on the circumstances, you may be unable to do anything else. Other steps to take after a pedestrian accident include:

  • If you are able, get a police report, document evidence and speak to witnesses. Even if you initially feel unharmed, stay at the scene until the police and an ambulance arrive. The shock and adrenaline from the accident can disguise serious injuries. If possible, use your phone or ask a witness to take photos or video of the scene. Get names and numbers from witnesses and the other driver as well.
  • Document your injuries. Keeping a careful record of your injuries and the medical treatment you receive can help ensure you receive fair compensation. Whether you were taken from the scene to the hospital or not, record the date and time of all treatments. Take photos of your injuries, if possible. Also record your levels of pain and the times you missed work.
  • Call a lawyer. A pedestrian accident lawyer can advise you on crucial steps to take to preserve your claim. If you are in the hospital, then an attorney can gather evidence on your behalf. A lawyer can also negotiate with the driver’s insurance company for you, protecting your interests.
  • DO NOT speak to the insurance company. The motorist’s insurance agency may call you soon after a pedestrian accident. However, you have no obligation to do so. Get an attorney’s advice before you say anything to an insurance adjuster.
